This summary explains the standard conditions under which Fast Safe Cargo (FSC) and its group companies carry, store and clear goods. It is draft text for legal review and is provided for information only; the transport document, booking confirmation and any signed agreement for a shipment take precedence.
01Scope and order of documents
These terms apply to ocean, air, road, rail and multimodal transport arranged or performed by FSC, as well as related warehousing, customs brokerage and handling services.
If documents conflict, the following order applies: mandatory law and international conventions; a signed service agreement; the bill of lading, sea waybill, air waybill or CMR consignment note; the booking confirmation; and finally these general terms.
- “Carrier” means the FSC entity named on the transport document.
- “Merchant” includes the shipper, consignee, holder of the bill of lading and anyone acting for them.
- “Goods” includes cargo, packaging and any container or pallet not supplied by FSC.
02Incoterms® 2020
Incoterms® 2020, published by the International Chamber of Commerce, set out when risk and cost pass from seller to buyer. They are agreed in the sales contract, not the transport contract, but they decide who books transport, clears customs and insures the goods.
FSC handles each shipment according to the Incoterm our customer confirms at booking. Terms for any mode of transport are EXW, FCA, CPT, CIP, DAP, DPU and DDP. Terms only for sea and inland waterway are FAS, FOB, CFR and CIF.
- EXW — Ex Works: buyer collects at the seller's premises and bears nearly all cost and risk.
- FCA — Free Carrier: risk passes when goods are handed to the buyer's carrier; preferred over FOB for containers.
- CPT / CIP — Carriage (and Insurance) Paid To: seller pays freight to destination; CIP requires all-risks (ICC A) cover.
- DAP / DPU / DDP — Delivered: seller bears risk to destination; under DDP the seller also pays import duties and taxes.
- FAS / FOB / CFR / CIF — Sea-only terms where risk passes alongside or on board the vessel at the port of loading.
03Merchant responsibilities
The Merchant must describe the goods accurately, including weight, dimensions, HS code, value and any dangerous or temperature-sensitive nature, and must pack and label them for the intended journey.
For containerised ocean shipments, the shipper must provide the verified gross mass (VGM) under SOLAS Chapter VI before the terminal cut-off. Containers without a VGM cannot be loaded.
- Supply complete and correct commercial invoices, packing lists, licences and certificates.
- Ensure goods are not prohibited, sanctioned or restricted on the route.
- Load, stow and seal shipper-packed containers safely, following the CTU Code.
- Pay freight, duties, demurrage, detention and storage when due.
04Liability by mode of transport
FSC's liability for loss or damage is set by the international convention or national law that applies to the stage of transport where the loss happened. If that stage cannot be identified, the limits for the main mode of transport apply.
Liability limits are stated in Special Drawing Rights (SDR), the IMF unit of account. FSC is not liable for indirect or consequential loss such as lost profit or market loss unless mandatory law requires otherwise.
- Ocean — Hague-Visby Rules: up to 666.67 SDR per package or 2 SDR per kilogram of gross weight, whichever is higher.
- Air — Montreal Convention 1999: up to 26 SDR per kilogram (revised limit in force from 28 December 2024).
- Road — CMR Convention: up to 8.33 SDR per kilogram of gross weight.
- Rail — CIM Uniform Rules (COTIF): up to 17 SDR per kilogram of gross weight.
- Warehousing and other services: as set out in the service agreement or FSC's standard trading conditions.
05Declared value and cargo insurance
Carrier liability limits are often well below the value of modern cargo. A higher value can be declared on the transport document before shipment, subject to an additional charge and FSC's acceptance.
FSC strongly recommends all-risks cargo insurance. Insurance can be arranged through FSC's cargo insurance service at booking.
06Claims and time limits
Visible loss or damage must be noted on the delivery receipt and reported in writing at delivery. Hidden damage must be reported as soon as it is found and within the time limits below. Keep the goods and packaging available for survey.
Legal proceedings must be started within the time bar of the applicable convention, or the claim is lost.
- Ocean: notice within 3 days of delivery for hidden damage; suit within 1 year.
- Air: written complaint within 14 days for damage and 21 days for delay; suit within 2 years.
- Road (CMR): reservations within 7 days (excluding Sundays and public holidays) for hidden damage; suit generally within 1 year.
- Send claims to claims@fastsafecargo.com with the booking reference, photos, survey report and commercial invoice.
07Dangerous and special cargo
Dangerous goods are accepted only when declared in advance with the UN number, proper shipping name, class and packing group, and when packed, marked and documented under the rules for each mode.
FSC may refuse, open, unload or dispose of undeclared or unsafe dangerous goods, and the Merchant is liable for resulting loss, fines and costs.
- Sea: IMDG Code.
- Air: ICAO Technical Instructions and IATA Dangerous Goods Regulations.
- Road: ADR; Rail: RID.
- Temperature-controlled cargo: set point and range must be stated on the booking; FSC is not responsible for cargo pre-cooled outside its range.
08Customs, security and trade compliance
FSC complies with customs, security and trade-control laws in every country it operates in, and expects the same of its customers and partners. Customs brokerage is performed under the authorisation the importer or exporter grants.
FSC screens customers, parties and shipments against applicable sanctions lists, including those of the UN, EU, UK and US, and will not handle goods or parties that breach sanctions or export-control rules.
- Advance cargo information: US ISF (10+2), EU ICS2 and equivalent filings require complete data before loading.
- Security programmes: ISPS Code at ports, AEO in the EU and C-TPAT in the US where FSC is certified.
- Export controls: dual-use and military goods need the correct licence before booking.
- Anti-bribery: facilitation payments are prohibited, in line with FSC's Anti-Bribery Policy.
09Charges, lien and delays
Freight is earned when goods are received, and charges are payable without set-off. FSC has a lien over goods and documents for any unpaid amounts and may sell goods to recover them where the law allows.
Schedules and transit times are estimates. FSC is not liable for delay except where an applicable convention or a written agreement says otherwise. Free time at terminals and depots is shown on the booking; demurrage, detention and storage apply after it ends.
10Force majeure, law and jurisdiction
FSC is not liable for failures caused by events beyond its reasonable control, such as war, piracy, strikes, port closures, extreme weather, epidemics or government action. FSC may re-route, store or discharge cargo at the nearest safe place.
Unless the transport document says otherwise, these terms are governed by the laws of England and Wales and disputes are referred to the courts of London, without affecting mandatory rules of the convention that applies.
